2) Issue notice for final disposal, returnable on 26/09/2024.

3) We direct the respondent No.1 to file affidavit dealing with his powers in the matter of not honouring the order dated 11/03/2024 issued by the Chief Executive Officer, Zilla Parishad, Yavatmal, thereby directing absorption of services of the petitioner.

4) The impugned communication depicts that the respondent No.1 has refused to honour the order on the ground that there is a vacancy of 'Scheduled Tribe' category and petitioner belongs to 'Open' category. In such an eventuality, it was open for the respondent No.1 to carry forward the reservation and honour the order of the respondent Chief Executive Officer, Zilla Parishad, Yavatmal.
