The contention is that during pendency of the proceedings before the Family Court and after passing of the interim order, the petitioner was superannuated and is getting pension of only Rs. 40,000/-. According to learned counsel for petitioner, application for modification of the order is pending before the Family Court. This is subsequent event to the passing of the impugned order. No interference is required in the impugned order.

In this scenario, petition can be disposed of by directing the Family Court to dispose of the application for modification of order, at the earliest, on its own merits. The petition is disposed of with above said direction.

Permission is granted to respondent to withdraw the amount deposited by the petitioner on usual undertaking. JUDGE Belkhede
