We have heard Mr. Kale, learned counsel for the petitioner for some time and also Mr. Mohata, learned counsel for the respondent nos.1 to 4 and 6.

Mr. Mohata submits that in compliance with the last order of this Court, an affidavit shall be placed on record during the course of the day and copy of which is already acknowledged by the counsel for the petitioner. Statement is accepted.

It is the case of the petitioner that vide order dated 17th August, 2024, she was transferred to Bhandara from Umred in the capacity of Cash Officer whereas her spouse is presently serving at Gondia. 4.

It is also not in dispute that there exists a policy of the respondent-employer of husband-wife being accommodated as far as possible at the same place.

An assurance is given that in the coming session, the petitioner and her husband shall be trying to be accommodated at the same place or the place where both can be posted, which are located in close proximity of each other.

As far as the issue of loss of pay is concerned, Mr. Kale, learned counsel appearing for the petitioner, has canvassed that vide transfer order another person was already posted at the place of the petitioner, however, the petitioner is sought to be posted on the very same place which has prompted her not to join.

Mr. Mohata submits that an appropriate submission on the said issue shall be made by tomorrow i.e. 13th November, 2024 along with record from the respondent-employer.
