We have perused the impugned communication dated 21/08/2024 issued under the signature of Superintendent of Police, Anti Corruption Division, Nagpur wherein recommendations are made to the employer and the Disciplinary Authority of the petitioner to initiate proceedings for suspension of the petitioner in pursuance of Government Resolution dated 12/02/2013.

Perusal of Government Resolution dated 12/02/2013 in our opinion, does not speak of any such powers conferred on the Superintendent of Police, Anti Corruption Division to recommend suspension of the petitioner.

That being so, we deem it appropriate to cause notice to the respondents for final disposal of the petition, returnable on 16/10/2024.

Shri D. V. Chouhan, learned Government Pleader waives service of notice for respondent Nos.1 and 3.

On our directions, Shri S.P. Bodalkar, learned counsel waives service of notice for respondent No.2.

Superintendent of Police, Anti Corruption Division, Nagpur is

There shall be status quo as to the services of the petitioner until further orders.
