The learned Assistant Government Pleader seeks further time to take instructions.

The learned counsel for the petitioner submits that the petitioner has already deposited the amount of penalty of Rs.13,332/- imposed by the concerned Tahsildar. It is submitted that the petitioner, without prejudice to his rights, is willing to deposit 50% of the amount out of peanlty amount i.e. Rs.1,00,000/- imposed by the Sub Divisional Officer. It is submitted that subject to the said deposit, the vehicle in question be released, as the livelihood of the petitioner is dependent upon the said vehicle.

Considering the facts and circumstances, the Tahsildar, Ghatanji shall release the vehicle in question, subject to deposit of Rs.75,000/- by the petitioner with the
