Mr. A. J. Pathak, learned counsel for petitioner submits that at the time of filing of the petition, the Presiding Officer at the CGIT and EPF Appellate Tribunal at Nagpur was not appointed. Now, he submits that the Presiding Officer is available and, therefore, he urged that the petition can be disposed of by continuing interim order granted earlier for a period of eight weeks.
