DATE : October 09, 2024 Shri Thakre, learned counsel representing the petitioners seek a direction to respondent No.2 to grant appointment to petitioner Nos.1 and 2 on the post of 'Pharmacy Assistant' in the wake of the fact that two posts; one from Ex-serviceman (OBC) category and another Exserviceman (Open) category are not yet filled in. We have to remind Shri Thakre of the settled position, that merely because the name of a candidate figure in the selection list, do not confer a right of appointment on him.

However, in the wake of the aforesaid, we deem it appropriate to issue notice to respondent No.2 so as to ascertain the position prevailing as on today. We also issue notice to respondent No.3 by making the same returnable on 12/11/2024. Hamdast granted. In addition, notice is also permitted to be serve by private mode of service.

Shri Sooraj S. Hulke, learned Assistant Government Pleader waive notice for respondent No.1.
