Learned counsel for the petitioner on instruction submits that the petitioner without prejudice to his rights, is willing to deposit the penalty amount. It is submitted that the truck in question be released as SKNair

Considering the facts and circumstances of the case, Tehsildar, Bhiwapur shall release the vehicle in question subject to deposit of the amount of penalty of Rs.1,18,474/- by the petitioner with the office of the concerned Tehsildar, Bhiwapur.
