APRIL 9, 2026 The Counsel for the petitioner has tendered across the bar a copy of The Maharashtra Zilla Parishads District Services (Recruitment) Rules, 1967, which, as such, ought to have been filed by the Counsel for the respondent no.2. She, however, submits that she could not lay hands to the said Rules, which statement appears to us to be surprising. The employer, i.e., respondent no.2, appears to have not even gone through the relevant Rules, and has filed reply opposing the prayers of the petitioner. We may remind respondent nos. 1 and 2 that their conduct should be of an ideal litigant. However, the conduct appears to us to be completely hostile, rather of the nature of a private party, wherein, an attempt is made to justify unjustified actions.

2] With the hope that the learned A.G.P. and Counsel for respondent nos. 1 and 2 shall meticulously go

14-WP-6194-2024 through the case papers, including the Rules under question, and make appropriate statement tomorrow, we adjourn the matter for tomorrow. We also direct the Collector, Yavatmal, and the Chief Executive Officer, Zilla Parishad, Yavatmal, to have a detail discussion on the point with their Counsels so as to enable them to make a fair statement/submission before the Court.
