The present Writ Petition, which was filed on 4th May, 2024, was listed for first time before this Court for admission. In the morning Session, the matter was called out, however, none appeared on behalf of the petitioner. Hence, the matter was kept at 2.30 p.m., in order to give one more opportunity to the petitioner to appear and argue the matter.

Perusal of the prayer clause reveals that the petitioner has approached this Court seeking its challenge to the impugned order dated 1st September, 2023 passed by the learned Civil Judge, Senior Division, Khamgaon, below Exhibit-16 in HMP No.136/2022. The aforesaid impugned order is passed by the learned Trial Court on an application moved by the respondent-wife under Section 24 of the Hindu Marriage Act, for grant of interim maintenance which was allowed and was to be continued till the disposal of the application. 3.

The aforesaid order is dated 1st September, 2023 and hence, the Court requested to Ms. Tajwar Khan, learned AGP to search for the current status of the

2 wp5745.2024.odt main proceedings pending before the Trial Court. 4.

When the matter was called out again in the second half, nobody appeared on behalf of the petitioner. Ms.Khan informs the Court that the main proceedings which were filed under Section 9 of the Hindu Marriage Act are itself disposed of on 14th June, 2025. Hence, the challenge to the interim order which was to be continued during the pendency of the main petition has been rendered infructuous.

In view of the above, the present writ petition is dismissed of as infructuous.
