Shri N. S. Rao, learned Assistant Government Pleader has placed before us the Work Order issued in favour of M/s Oberai Constructions, Akola on 24/09/2024 and he also make a statement that the work under the tender notice is already commenced.

When confronted with the said order, the learned Senior Advocate Shri M. G. Bhangde seek liberty to amend the petition to raise a challenge to the Work Order dated 24/09/2024. The learned Senior Advocate insist upon hearing on ad-interim relief.

Since the Work Order is issued, we deem it appropriate to direct the respondents/State as well as respondent No.5 to file affidavit in reply on or before 05/10/2024.

Shri Bhangde, learned Senior Advocate also seek leave to delete respondent No.6 from the array of respondents since the Work Order is allotted in favour of respondent No.5.

Leave granted as prayed for. Upon the amendment is carried out, copy of the petition shall be served on the contesting respondents. 6.

We deem it appropriate to list the petition on 08/10/2024 with an understanding that the petition shall be taken up for hearing finally at the stage of admission.
