DATED : 27-09-2024 Mrs. Hiwase, learned Counsel for the petitioner, seeks permission to delete respondent No.1. Amendment to be carried out forthwith. Re-verification dismissed. 2.

The learned Government Pleader raise a preliminary objection about the maintainability of the writ petition before the Nagpur Bench as, according to him, though the work under the tender is to be undertaken in Nagpur, the entire processing of the bids have occurred in Mumbai. 3.

Mrs. Hiwase, learned Counsel, however, disputes this assertion by inviting our attention to page 135 of the petition where we can find that the authorities who have undertaken the scrutiny, have singed at Nagpur, Akola, etc. 4.

She also expressed an expression that if the tender is going to process, the petition will be rendered infructuous. We find that if at the hearing, the parties are convinced that

2 wp5760.24 the petitioner sneaked out of the process in an illegal manner, we may set aside the entire tender process and, therefore, we are inclined to adjourn the proceedings to 30-9-2024. 5.

The Government Pleader waives notice for respondent No.2.
