Heard Mr. M. Rajkondawar, learned counsel for the petitioner, Mr. A.G. Mate, learned AGP for the respondent/State and Mr. D.C. Chahande, learned counsel for the respondent No.12.

After going through the order dated 31.05.2024 passed by the Divisional Commissioner, Nagpur in Revision No.115/RTS-59/2019, I find that when the matter was decided, neither the counsel for the petitioner nor the petitioner were present, therefore, to give one more opportunity to the petitioner, the order dated 31.05.2024 passed by the Divisional Commissioner, needs to be set-aside thereby remanding the matter back to the Divisional Commissioner, Nagpur subject to cost of Rs.25,000/- (Rupees Twenty Five Thousand Only) which shall be paid to the Bar Library, High Court of Judicature at Bombay, Bench at Nagpur.

In view thereof, the writ petition is partly allowed. Divisional Commissioner, Nagpur is hereby directed to decide the matter within a period of two months from today. The cost shall be deposited within a period of two weeks from today.
