The learned AGP submits that remedy of appeal is available to the present petitioner against the impugned order.

The learned counsel for the petitioner submits that Murum is not the minor minerals and therefore, impugned orders are without jurisdiction. It is submitted that petitioner has already deposited the amount of penalty imposed by the Tahsildar, Babhulgaon, District Yavatmal. 3.

Considering the facts and circumstances, I am not inclined to relegate the petitioner to appellate remedy. 4.

Issue notice to the respondents, returnable on 26.11. 2024.

Ms. M. A. Barbade, learned Assistant Government Pleader waives service of notice on behalf of respondent nos.1 to 3/State.

As the petitioner has already deposited the amount of penalty imposed by the Tahsildar, the seized vehicle shall be released on execution of bond.
