We have heard Mr. Neeraj Patil, Assistant Government Pleader for State.
The State is aggrieved by the judgment dated 13.12.2023 passed by the Maharashtra Administrative Tribunal in O.A.No.647 of 2021, thereby directing the original respondents to pay interest @6.85% to the original applicant for the delayed period i.e. from 25.03.2019 till the actual payment of arrears of pay in terms of the order dated 25.03.2019.
The stand of the State is to the effect that since the original applicant himself was absent for 572 days and 70 days respectively, they have not paid arrears as per the order dated 25.03.2019. 2.
Though we have noted that the leave of the applicant/ respondent herein for the period of absence was subsequently granted by the original respondents, we deem it appropriate to issue notice to the respondent, making the same returnable on 19.11.2024.
910-WP-5821-2024.odt 2 Though we are informed that the State is being prosecuted under the Contempt of Courts Act, we direct the Tribunal to defer hearing of the Contempt Petition till the writ petition filed by the State is heard upon appearance of the respondent.
