The petitioner is challenging the order dated 26.07.2022 passed by the Sub-Divisional Officer, Bhandara, whereby, the respondent No.2 has reviewed its earlier order dated 03.11.2021 without giving an opportunity of hearing to the petitioner.

Having gone through the order passed by the authority, it is clear that while passing the said order, the petitioner was not heard and therefore, on this count alone, the order is liable to be set-aside.

In view thereof, the present writ petition is partly allowed. The order dated 26.07.2022 passed by the respondent No.2 is hereby quashed and set-aside. Respondent No.2 is directed to decide the matter afresh by giving an opportunity of hearing to the petitioner as well as all concerned persons within a period of three months from today.
