Heard.

2.

The order impugned dated 17.4.2023 does not appear to be in tune with the provisions of sub-rule (9) of rule 12 of the Maharashtra Scheduled Tribes (Regulation of Issuance and Verification of) Certificate Rules, 2003. The respondent Committee if was not in agreement, should have decided either way by granting or rejecting the claim for validity. As such the matter stands restored to respondent Committee before whom the petitioner shall appear on 22.10.2024. We direct the respondent Committee to pass the appropriate orders as per law by considering the above provisions within a period of three months from the date of appearance.

3.

Petition stands partly allowed.
