The learned counsel for the Petitioner submits that the allegations against the Petitioner are of flouting transport permit condition only and there are no allegations of transporting the sand illegally. It is submitted that, still the Petitioner without prejudice to his rights is willing to deposit 50% of penalty amount and subject to such deposit the vehicle in question be released as the livelihood of the petitioner is dependent upon the said vehicle. 3.

The total amount of penalty is Rs.3,60,000/-. Considering the facts and circumstances of the case, the respondent no.3 - Tahsildar, Bhandara shall release the vehicle in question subject to deposit of Rs.1,80,000/- with the office of the said Tahsildar.
