Heard learned Counsel for the respective parties. (2) It appears that the Education Officer (Secondary), Zilla Parishad, Amravati rejected the approval on the ground that there are certain discrepancies in the proposal.

(3) It is the contention of the Petitioner as well as the Management that the discrepancies have already been removed. Therefore, the Education Officer ought to have granted approval to the proposal submitted by the Management in respect of the Petitioner. It appears that no opportunity of hearing was granted to the Petitioner as well as the Management to make submissions on the discrepancies. ..

924wp6043.24 924wp6043.24 (4) As such, the impugned order dated 05/12/2022 passed by the Respondent No. 1 - Education Officer (Secondary), Zilla Parishad, Amravati is hereby quashed and set aside. The Education Officer shall grant four weeks' time to the Petitioner as well as the Management to remove the objections/discrepancies, and if required, also grant opportunity of hearing to them.
