Vide impugned order the Enquiry Officer has disqualified the defence representative under the relevant Rules. 3.

It is urged by the counsel for the petitioners Mr. Kinkhede that the Enquiry Officer without hearing or putting the petitioners or to notice passed the impugned order. He would demonstrate from the record that defence representative Mr. Kamal Rangwani is qualified to defend the petitioners in departmental proceedings in terms of Bank's laid down guidelines.

In this background, we deem it appropriate to permit the petitioners to approach before the Chief Manager & Enquiry Officer in response to the impugned communication dated 13th September, 2024 thereby demonstrating that Mr. Kamal Rangwani, the defence representative of the petitioner-delinquent as per the Bank laid down Guidelines can represent his interest being representative of the registered trade union of bank employees.

In case, if the petitioners approach the said authority, we direct the said authority to deal with the representation of the petitioners expeditiously by passing a reasoned order.
