ATE : APRIL 07, 2025 1) Heard learned counsel for the parties.

2) The petition questions the decision of the respondent No.1 Caste Scrutiny Committee dated 07/11/2023 whereby the claim of the petitioner belonging to Scheduled Caste 'Mahar' (entry No.37) has been turned down. The only pre-constitutional document on which reliance was placed by the petitioner, was an entry in the birth record of a son being born to Vithu Mahar regarding which entry has been taken on 05/01/1927. This entry was verified by the Vigilance Cell. However, the petitioner, who claims to be a permanent resident of Village Pipari, Tahsil Arvi, has been unable to establish his relationship with Vithu/Ithu Mahar. We have perused the original record, and find that neither the application filed by the petitioner nor the information supplied under Rule 16 of the Maharashtra Scheduled Castes, De-notified Tribes (Vimukta Jatis), Nomadic Tribes, Other Backward Classes and Special Backward Category (Regulation of Issuance and Verification of) Caste Certificate Rules, 2012

ORDER DATED 07/04/2025 2 19-wp 6066.2024.doc indicates anything regarding the shifting of the residence of the aforesaid Ithu Mahar or for that matter his son Sakharam, from Arvi to Pipari. Mr.Karode, has also not been able to point out to us any material to indicate the linkage between Vithoba alias Ithu, to whom the entry of 1927 is attributed with the ancestor of the petitioner. There being no other material being brought to our notice, we do not see any reason to interfere in the impugned decision. Therefore, the petition stands dismissed. Original R & P be returned. No costs.
