We have heard the respective Advocates for some time. It is borne out of record that the issue sought to be canvassed by the petitioner, which is referred in the order of this Court dated 12.11.2024, is covered. 2.

In this background, we deem it appropriate to allow the petition thereby quashing the impugned communication dated 14.8.2024 issued by the respondent No.3.

We direct the respondent No.3 to pass a fresh order in accordance with the law as laid down in the case of Saify School Managing Committee, Khamgaon and others V/s. State of Maharashtra and others in Writ Petition No.1684/2023 decided on 2.2.2024, so also the order of this Court in Writ Petition No.4790/2018 Sheikh Aasim Sheikh Farid V/s. Education Officer Sec.), Zilla Parishad, Buldhana and others decided on 3.5.2024.

Let the order be communicated to the petitioner within a period of eight weeks from today.
