Though the respondent No.1 has not filed reply to the petition, however, Mr. Wadodkar, learned counsel for the respondent No.1 makes a statement that since there was a dispute regarding measurement done by the respondent No.4, who is an Architect of the Agricultural Produce Market Committee, the respondent No.1 has already written a letter to the Public Works Department, Pandharkawada, for determining the exact measurement of the work done by the petitioner in order to take a decision regarding the work made by the petitioner. His statement is accepted.
2 25-6137-24.doc Apart from this, he does not dispute that the issue involved in the present petition and Writ Petition No. 6138/2024 is identical and, therefore, he submitted that in view of the same, an appropriate order would be passed. In view of this, it would be appropriate, if the respondent No.1 is directed to get the measurement done from the Executive Engineer, Pandharkawada as early as possible and based on such measurement, decide the quantum of payment to be made to the petitioner, as the question of allotment of work is not disputed. The same shall be done as far as possible within a period of four weeks from today. The petition is disposed of according to the above terms. No costs. 3.
