In this writ petition, the petitioners have assailed the validity of the order dated 3.10.2023 passed by the Maharashtra Administrative Tribunal by which the petitioners are directed to enter the name of respondent No.2 in the waiting seniority list for appointment on compassionate ground within a period three months.

Mr. M.K. Pathan, the learned Assistant Government Pleader for the petitioners submits that the Tribunal ought to have appreciated that the claim made by the mother for compassionate appointment is rejected on 20th June, 2017. It is further submitted that the Tribunal ought to have appreciated that the period of 18 years have lapsed since the date of death of employee, namely, late Mr. Anil Gayakwad.

In view of aforesaid submissions, issue notice to the respondents, returnable on 28.2.2025.
