In the present writ petition, the challenge is raised to the order dated 29/07/2024, passed by respondent No.3 - Chief Manager (Personnel) / HOD (Executive Establishment), Coal India Limited. This order was passed on representation made by the petitioners on 09/01/2024. The grounds raised in the representation were dealt with by the respondent No.3, and passed the impugned order refusing to grant benefits, as prayed in the representation.

In the petition, now the petitioners have come up with new grounds which are not mentioned in the representation. Today, a bunch of documents came to be supplied across the Bench by pointing out that certain circulars and judgments were not considered by the respondents. Whereas all this material was not placed before the respondent No.3 while taking decision.

In the circumstances, the material which was never placed before the respondent No.3, the order cannot be faulted with for not considering such material. 4.

In that view of the matter, the appropriate mode will be that the petitioners shall approach respondent No.3 with a detailed representation, stating and raising all the points which, according to the petitioners are in their favour for seeking benefits which the petitioners are claiming in present petition. 5.

Accordingly, we dispose of the present petition with liberty to the petitioners to file a fresh representation.

If such representation is made by the petitioners, respondent No.3 is directed to take decision on the same within four months from the date of submission of such representation and communicate the order / decision to the petitioners within two weeks from the date of decision.

Petition is disposed of in above terms.
