The petitioner entered into service with the respondent No.2 from 08/10/1991, since when the petitioner is serving at Nagpur i.e. for almost last more than 35 years.

The petitioner is on promotion and is transferred to Amravati, which is a question on the ground of personal hardship. Our attention is invited to the petitioner being single parent and the adverse health condition of his daughter. According to the petitioner, even the Government Resolution dated 09.04.2018 protects his case.

We see no reason to cause interference, as unless it is demonstrated that the transfer is malafide, the Court is not required to cause interference.

However, we deem it appropriate to direct the respondents to consider the recommendations made by the Executive Engineer on 10/09/2024 produced at annexure 11 having regard to the Government Resolution dated 09.04.2018 and pass appropriate order within a period of four weeks from the date of production of this order by communicating the same to the petitioner.
