Heard Mr. A.Y. Kapgate, learned counsel for petitioners and Mr. R.V.Bhanarkar, learned counsel for the respondents. 2.

The only issue raised in all these petitions is that the Complaints were filed against the Zilla Parishad, wherein the learned counsel for the petitioners makes a statement that the employees in question were appointed under the National Rural Health Mission. It is an admitted position that the Competent Authority was not impleaded as a party-respondent before the Industrial Court. Therefore, on this ground alone, the matters deserve to be remanded back to the Industrial Court for fresh consideration.

Having considered the submissions advanced by both

wp6246.2024.odt 2/2 sides, it is an admitted position that the National Rural Health Mission was not impleaded as a party-respondent in the Complaints before the Industrial Court. On that ground alone, the matters are required to be remanded back to the learned Industrial Court for fresh adjudication. The learned counsel for the petitioners seeks two months' time to move appropriate application before the Industrial Court. Time, as prayed for, is granted. All points raised in these petitions are kept open.

In view thereof, all petitions are partly allowed. The orders dated 11.03.2024 in ULP Nos.19/2019, 25/2019, 27/2019, 28/2019 and 29/2019 passed in Complaints by the Industrial Court are hereby quashed and set aside.
