Learned counsel for the petitioner submitted that due to the pendency of departmental enquiry and criminal proceeding, the present petitioner was denied with the promotion. He submitted that, since 2024 even no charge sheet is issued to him. Thus, considering the developments, his plea of promotion be considered. He also placed reliance on the decision of this Court in Writ Petition No.1672/2022 [Ashok Madhukar Nand Vs. The State of Maharashtra and Ors.] decided on 05.10.2023, wherein the similar situated person was considered by the Court for entitling him for the promotion.

Learned counsel for respondent Nos.2 to 4 has invited our attention towards the para No.26 of the similar judgment. She also invited our attention towards the order passed in Writ Petition No.2100/2026 [Shilpa D/o
(2) 10.wp.6260.2024 Sukhdeo Gawande Vs. State of Maharashtra and Others] dated 10.03.2026, wherein this Court, while disposing of the writ petition given a direction to the respondent No.1 to decide the representation of the petitioner within a period of eight weeks from the date of production of this order. She submitted that the department is already taking steps regarding the suspension and she wants to seek instructions, therefore, she seeks some time.
