After hearing the learned Counsel for both sides for sometime, learned Counsel for both sides unanimously state that order passed by the trial court below Exhibit-5 so also the order passed by the Appellate Court in Misc. Civil Appeal No. 86/2022 deserve to be set aside. They submit that trial court be directed to decide application (Exhibit-5) afresh within stipulated time. 3.

In view of the above, impugned order is set aside so also the order passed by the trial court below Exhibit-5 in Regular Civil Suit No. 8/2022 is set aside.
