Since the proposal of petitioner for enhancement of the age of retirement from 62 to 65 years came to be rejected by the impugned order for the reason that, as per the Clause, the proposal was not submitted at least one month before to the date of retirement by the Director, a specific query was made as to the object and purpose behind prescribing a period of one month for submission of such proposal by the Director, before the date of retirement.

The learned Additional Government Pleader seeks time to clarify the same and to file an affidavit in that effect. Accordingly, time of two weeks is granted to the learned Additional Government Pleader to submit such affidavit. We expect that the affidavit shall contain the difficulties, if any, that the State would face in cases where the proposal is submitted not before one month of the date of retirement or beyond the date of retirement.
