Heard learned Counsel for the Petitioner, the learned Deputy Solicitor General of India and learned AGP, who are representing the Respondents.

It appears that an appropriate proposal by the Assistant District Magistrate and Land Acquisition Officer, Pusad, District Yavatmal has been made to the Collector, Yavatmal for payment of the compensation to the Petitioner, as is apparent from the communication dated 7th February, 2023, to the Deputy Chief Engineer (Construction), Central Railways, Yavatmal Road, Wardha which has been enclosed at Page 15 of the Petition.

In view of the aforesaid, we dispose of this Writ Petition with a direction to the Collector or the competent authority concerned to take a final decision in the matter on the said proposal and in case the Petitioner is found to be entitled to be paid compensation, the same shall also be paid to the Petitioner. 4.

The decision under this order shall be taken by the competent authority or the Collector within a period of one month from the date a certified copy of this order is produced before him, whereupon payment of compensation shall also be made to the Petitioner within next three weeks thereafter. 5.
