It is the contention of the Counsel for petitioner Mr. Sharma that the issue is covered by the Division Bench judgment delivered at Aurangabad in Writ Petition No.82 of 2020 (Tejerao s/o Suryakant Pawar Vs. The State of Maharashtra and others) decided on 28th September, 2021, which is at Annexure-IX. 5.

In this background, we direct the respondent nos.2 to 4 to verify as to whether the issue is sought to be canvassed, which is covered by the said judgment. The respondent should be sensitive in a fact that before the cut-off the date, the petitioner has already acted for examination, however, the result was declared beyond the prescribed time limit, which act was not within the control of the petitioner.
