The delay of more than 20 years came to be condoned which is under challenge. It is submitted that without recording observations and without recording sufficient reasons delay came to be allowed.

Ms. H. S. Dhande, the learned Assistant Government Pleader waives service of notice for respondent Nos.2 and 3/State.

The petitioner is permitted to serve the respondent Nos.1 and 4 by private mode of service, in addition to regular mode of service and file an affidavit of service by next date, failing which the petitioner shall deposit costs of Rupees Five Hundred with the High Court Legal Services Sub-Committee, Nagpur.
