The petitioner was granted a licence for performance of public amusement in terms of Rule 109 of the Licensing and Controlling Place of Public Amusement (Other Than Cinemas) and Performance for Public Amusement Including Pool Game Parlours, Amusement Parlours, Providing Computer Game, Virtuality Reality Game, Cyber Cafes, Games with Net, Internet or Internet Connectivity, Bowling Alleys, Card Room, Social Clubs, Sports Clubs, Caberate Perofmrances, Discotheque, Games, Melas and Tambolas, 1960 Amended Rules, 2000 as published in the gazette dated 25/10/2007. The licence was granted in September, 2014 for a period upto 31/12/2014. The petitioner thereafter has filed an application for KHUNTE

25-wp6916.24.odt 2/2 renewal of the license, which has been favourably recommended by the Tahsildar Malegaon by his communication dated 13/09/2024, having accepted the monthly fees upto 30/08/2024 (Pg.18) as is indicated therefrom. The SDO, however by the communication dated 08/08/2024 has written to the Assistant Charity Commissioner, Washim making an enquiry in respect to the aims and objects of the petitioner. What is necessary to note, is that the licence (Pg.13) granted to the petitioner earlier in point of time indicates, that it has a registration No.Maharashtra/543/2014, dated 26/08/2014, which would indicate, that the said society has been registered under some Statute. That being the case, the petition at the behest of the petitioner would not be maintainable. In view of which, Mr.Kurekar, learned counsel for the petitioner, seeks permission to withdraw the petition with liberty to file a separate petition by the aforenamed society. Statement is accepted. The petition is dismissed as withdrawn with liberty as prayed for.
