DATE : 05.05.2025 Prima-facie, it appears that the application under Order 41 Rule 27 of the Code of Civil Procedure came to be rejected. In fact, there are various judgments on this issue when such an application is filed, it may be considered at the time of final hearing. However, in the present matter the ground is raised that in spite of due diligence, that document could not be brought on record. Secondly whether that document is necessary to resolve the controversy in the dispute, even an application for amendment also required to be considered at any stage.

Prima-facie it appears that both the applications considering the facts, ought to have been allowed. However, considering the paucity of time, writ petition cannot be taken up for final hearing at the stage of admission. However, proceedings of RCA No.11/2017 are hereby stayed till 11.06.2025. 3.

List the matter for further consideration on 11.06.2025.
