Issue notice to the respondents, returnable on 03.02.2025. 3.

In view of the reasons cited in the impugned order, we are of the view that for effecting representation in the Departmental Proceedings and in compliance with the principles of natural justice, the petitioner's request for grant of permission to appoint defense representative could have been granted to him. 4.

In this background, further Departmental Proceedings shall remain stayed.

We hereby clarify that, in case, if the respondent-authority permits the petitioner to appoint a defense representative, it is necessary to communicate such order to the petitioner and to continue with the Departmental Proceedings.
