The petitioner is an approved teacher. She was transferred to fully aided school as a Biology teacher and this Court directed the Education Officer (Secondary) to grant approval. The respondent No.1-Education Officer (Secondary) granted approval vide its order dated 24/02/2022. However, the same was granted in phase-wise manner like on 40% aided basis w.e.f. 01/04/2018, 60% w.e.f. 01/04/2019, 80% w.e.f. 01/04/2020 and 100% w.e.f. 01/04/2021. The said order is under challenge in the present petition. 3.

The learned counsel for the petitioner placed reliance on the judgment in Writ Petition No.7718 of 2022 (Nishant Madhukar Somkuwar v. Education Officer (Secondary), Zilla KHUNTE

1-wp7217.24.odt 2/2 Parishad and Ors.) decided on 16/10/2023, wherein this Court by relying on the judgment in Sandhya d/o Balkrushna Teli and others v. State of Maharashtra and others at Principal Seat in Writ Petition (Stamp) No.93919/2020 decided on 12/03/2021, allowed the petition and directed the Education Officer to grant approval to the transfer of the petitioner on 100% grant-in-aid basis. The learned AGP has fairly conceded that the issue involved in the present petition is already covered by this judgment.

In view thereof, the present petition is allowed. 5.

The respondent No.1-Education Officer (Secondary), Zilla Parishad, Gondia is hereby directed to grant approval to the transfer of the petitioner from unaided to aided section with effect from 01/04/2018 as Biology teacher on 100% grant-in-aid basis.

The petition stands disposed of. No costs.
