(2) In this Petition, the Petitioner challenges the order dated 19/08/2016 passed by the learned Maharashtra Administrative Tribunal dismissing the Revision in default on the ground that the Petitioner was continuously absent. However, the Rozanama shows that the Petitioner lastly appeared on 25/04/2016, and thereafter, there is no appearance either on behalf of the Petitioner or the Respondents.
(3) The observation in the impugned order that the Petitioner is absent since 15/02/2016 is incorrect. However, it appears that there is no application filed by the Petitioner for restoration of the Revision. ....A....
1wp7235.24 1wp7235.24 (4) In view of this fact, there is no necessity to issue notice to the other side. Learned Counsel for the Petitioner seeks permission to withdraw the Writ Petition with liberty to file application for restoration of the Revision.
(5) The Writ Petition stands dismissed as withdrawn with liberty as prayed for.
(6) Learned Maharashtra Revenue Tribunal is hereby requested to consider the application for restoration of the Revision, if filed by the Petitioner, on its on merits even by imposing costs.
