Heard learned Counsel for the respective parties. (2) The grievance of the Petitioner Nos. 3 and 4 is that by way of the communication dated 03/12/2024, the Respondent No. 3 - Education Officer (Primary), Zilla Parishad, Gadchiroli refused to release 20% salary of the Petitioner on the ground that the Petitioner Nos. 3 and 4 have not acquired the requisite qualification of TET. However, in view of the judgment of the Hon'ble Apex Court in Anjuman Ishaat-ETaleem Trust vs. The State of Maharashtra & others (Civil Appeal No. 1385/2025 and connected Appeals), the period for acquiring the TET qualification is extended by two years from the date of passing of the order i.e. 01/09/2025.

935wp7323.24 935wp7323.24 (3) In view of the above cited judgment of the Hon'ble Apex Court, the reason for refusing to release the salary of the Petitioner Nos. 3 and 4 does not exist. As such, the impugned communication dated 03/12/2024 issued by the Respondent No. 3 - Education Officer (Primary), Zilla Parishad, Gadchiroli is hereby quashed and set aside. The Respondent No. 3 is hereby directed to grant approval for releasing the pending as well as the regular salary of the Petitioner Nos. 3 and 4, on 20% grant-in-aid basis after due verification, within a period of one month.
