The present Petition is filed by the Petitioner claiming that he belongs to 'Rajput Bhamta' NT. He was selected and appointed on the post of Clerk in the office of the Respondent on 26/03/1999. (2) The caste claim of the Petitioner was forwarded to the Caste Scrutiny Committee for verification. His caste claim was invalidated vide order dated 29/07/2011. The same was challenged by the Petitioner by filing Writ Petition No. 4022/2011. In the said Writ Petition, this Court directed the Scrutiny Committee to decide his claim within two months. It is also mentioned in the said order that if the claim of the Petitioner is validated, his termination order dated 29/07/2011 shall stand quashed and set aside and he shall be entitled to relief of reinstatement with all the consequential benefits. 32wp7396.24 32wp7396.24 another Writ Petition No. 136/2015 and sought direction to the Respondent to reinstate the Petitioner in service and grant protection of his service in view of the judgement of Full Bench of this Court in the case of Arun Sonone vs. State of Maharashtra, 2015(1) ALL MR 799 (F.B.).

(3) This Court, by order dated 03/02/2016 allowed the said Writ Petition No. 136/2015. Against the said order, the Respondent preferred an Appeal before the Hon'ble Apex Court bearing SLP No. 21129/2016. The Hon'ble Apex Court allowed the SLP and quashed and set aside the order passed by this Court dated 03/02/2016 in the said Writ Petition. In view of this position, the Petitioner is out of employment since 2011. Moreover, he has not challenged his invalidation before this Court. Even the Government Resolution dated 14/12/2012 is of no help to the Petitioner.

(4) In view of the above, the Petition is devoid of merits and is accordingly dismissed. Pending Application(s), if any, stand(s) disposed of.
