The petitioner who is a resident of Mandur Tinto, Ilhas made a complaint dated 12.6.2023 to the Sarpanch/Secretary of village Panchayat, Azossim Mandur Tiswadi Goa about the illegal construction mentioned therein. Learned counsel for the petitioner submits that the two storied building is constructed by the Ex-Sarpanch of the Village Panchayat and is abutting the village road. It is submitted that the construction is illegal and made without any permission being obtained and without leaving any setback.

3. Our attention is invited to the communication dated 15.5.2023 of the Village Panchayat indicating that there is no record available with the panchayat as regards the permission to construct the house which is the subject matter of the complaint.

4. This petition can be disposed of by directing the Village Panchayat to take appropriate action on the complaint dated 12.6.2023 which is at page 19 of this petition and if it is found that the structure is illegal, proceed with the demolition in accordance with law.

5. Copy of this petition along with a copy of this order be placed on the record of the Village Panchayat for necessary action. The Village Panchayat is directed to take the complaint dated 12.6.2023 to its logical conclusion within a period of two weeks from the date this order is placed on record.
