2. The issue involved in this matter is that, in the circumstance that the Defendant No.7 is not a Defendant in the first suit i.e. SCS No.31/2001 (new) RCS No.97/2015/F, whether the second suit i.e. RCS No.116/2002/F would require to be stayed and the trial in the two suits can be consolidated.
