1. Ms. Marie Rosette Pereira waives service for Respondent Nos. 1 to 7 and 9 to 12 and reports that Respondent No.8 has expired. She submits that the legal representatives of Respondent No.8 i.e. Original Plaintiff No.8 have been brought on record. By consent, the legal representatives shall be impleaded as Respondent Nos. 8(a) and 8(b). Amendment to be carried out forthwith. Learned Advocate Ms. Marie Rosette Pereira waives service for these Respondents and would also file Wakalatnama for Respondent Nos. 8(a) and 8(b).

3. This is an Appeal against an order dated 27.08.2024. The findings given by the Trial Court are only prima facie findings and at this point of time, do not call for an interference. The findings, which are prima facie, shall not influence the disposal of the suit on its own merits.

4. The parties have submitted that the trial in the suit has now commenced, and the evidence of the Plaintiff is being recorded. Considering that the suit was filed in the year 2022, and considering that the parties involved are senior citizens, and most of the evidence is of a documentary nature, it would be advantageous to them if the Trial Court is requested to dispose of the suit, i.e. Regular Civil Suit No. 82/2022/A, in an expeditious manner and preferably by 31.12.2026.

5. In this view of the matter, the petition stands dismissed with the above observations.
