1. Heard Mr. S. S. Kantak learned senior counsel with Ms. S. Desai, Advocate for the petitioners.

2. Leave is granted to amend prayer clause (III).

3. The amendment to be carried out forthwith.

4. Mr. Kantak would submit that though the Plaintiff/Petitioner partitioned the property, the road which is shown in the said plan is not specifically reserved for plot 'E' and 'F". He submits that the learned Trial Court correctly appreciated the fact. However, in the appeal, the First Appellate Court reserved such findings by arriving at the wrong findings.
