1. During the pendency of the present Writ Petition, it transpired that certain documents were not filed before the Village Panchayat.

2. Heard Mr. Talalikar, learned Counsel appearing for the Petitioner and Mr. Kamat, leanred Counsel appearing for the Respondent.

3. Both Counsels agree that since some of the documents were not produced before the Village Panchayat, the matter may be remanded to the Village Panchayat for considering afresh, after placing on record of the Village Panchayat proceedings, the said documents by the Petitioner.

4. In view of the aforesaid, the impugned order dated 28th July, 2023, issued by the Village Panchayat, order dated 5th January, 2024, passed by the Additional Director of Panchayats in Panchayat Appeal No.308/2023 and impugned order dated 30th April, 2024, passed by the Revisional Court in Revision Application No.8/2024, are quashed and set aside. The demolition proceedings is remanded to the office of the Village Panchayat to be heard afresh.

5. The Petitioner is permitted to file additional documents before the office of the Village Panchayat in the demolition proceedings on or before 6th April, 2026. The Panchayat Committee is requested to accept the said additional documents filed by the Petitioner and the Panchayat Committee is requested to decide the demolition proceedings afresh, after considering the additional documents that are filed by the Petitioner. The Panchayat Committee is also requested to expedite the hearing of the said proceedings.

6. It is needless to state that all contentions of all parties are left open.

7. Petition is disposed of accordingly.
