As per office note, the counsel for appellant has not supplied copy of Arbitration Appeal for issuing notice to respondent no. 3. Sufficient time was granted on 13.06.2024, 04.07.2024, 25.07.2024 and on 16.08.2024 for supply of the copy. Today is 5th default. However, the appellant has failed to supply the copy.

Hence, due to non supply of copy, inspite of granting sufficient opportunity, the present matter shall stands dismissed against respondent no.3 in default, in terms of Chapter VII Rule 2 (iii) of the Bombay High Court Appellate Side Rules, 1960 without reference to the Court of Registrar (Judicial), if copy is not supplied within four weeks from today. If copy is supplied within the time specified as above, thereafter issue notice to the aforesaid respondent, returnable within six weeks.
