It is stated that the respondent no.3 could not be served on the given address and whereabouts of the said respondents are not known. It is further stated that the said respondent no.3 neither appeared nor contested the matter before trial Court and the respondent nos. 1 and 2 are only contesting parties.

Thus, the applicant/petitioner prays for deletion of name of respondent no.3 from the array of the respondents. The application is supported by Affidavit sworn by power of attorney holder by the petitioner.

Considering the reasons mentioned in the application, the petitioner is permitted to delete the name of respondent no.3 from the array of respondents, at the risk of petitioners. Necessary amendments be carried out in the matter.
