CAW No. 716/2024 in WP No. 2859/2021 Coram : Registrar (Judicial) Dated : 06.03.2024 This application is taken out for permission to serve respondent no. 4 in accordance with the provisions of Order 5 Rule 17 of the Code of Civil Procedure.
That the notice issued to the above said respondent on the given corrected address is received back unserved as the door was locked. The learned counsel for the applicant submits that the said respondent is deliberately avoiding service of notice of the present petition.
It is further stated that the given corrected address of respondent no. 4 was itself provided by the said respondent in lower Court proceedings as her registered address. Therefore, the applicant wants to serve the aforesaid respondent by affixing copy of notice on the wall of the house of the respondent.
Considering the reasons mentioned in the application and the bailiff report, the applicant is permitted to serve the aforesaid respondent by affixing the notice on the conspicuous place or outer door.
Service of notice be effected on respondent no. 4 by affixing copy of notice on some conspicuous part or outer door of the house on the last known address of the aforesaid respondent in terms of Order V Rule 17 of C.P.C.
