It is stated in the application that the notice issued to the aforesaid respondent received back unserved since as per the bailiff report the noticee is not residing on the given address. The applicant states that the given address is the correct address and the noticee is residing on the same address. Thus, the applicant prays for grant of permission to issue fresh notice by Hamdast.

Considering the reasons mentioned in the application, the applicant is allowed to serve the respondent no.3 by fresh hamdast, through Court, returnable within four weeks.
