It is stated that the notice issued to respondent no.3 was received back unserved as the said noticee is reported to be dead as per the bailiff report. Thus, the petitioner prays for deletion of respondent no.3 from the array of the respondents. The application is supported by affidavit.

Since the application is formal in nature and supported by affiddavit, the same is allowed. The petitioner is permitted to delete the name of respondent no.3 from the array of respondents, at the risk of the petitioner. Necessary amendment be carried out.
